Lindsay Lohan guilty of ‘extremely poor judgment, but no jail after reportedly failing alcohol test

Lindsay Lohan won’t be sent to jail after reportedly failing an alcohol test because a previous judge did not require the troubled starlet to undergo alcohol monitoring, only drug monitoring, and even then, just through Feb. 25, TMZ.com reports.

But Judge Stephanie Sautner did chide Lohan for showing “extremely poor judgment” by throwing a party at her Venice., Calif., house where she is serving time under house arrest for probation violation stemming from two DUIs dating back to 2007. Sautner told Lohan that she can only have one person over at a time, in addition to family members, for the remainder of her house arrest stint.

A judge last year ruled that Lohan had violated her probation by failing to attend alcohol education classes. That led to a short stint in jail followed by some in-patient rehab, but after being released, she then failed an alcohol monitoring test. That prompted a lengthy stay at the Betty Ford Clinic. A few weeks after her release, she was arrested for stealing a necklace from a Venice, Calif., jewelry store. She pleaded no contest to the charges in May and was sentenced to serve four months in jail, along with another concurrent four-month sentence for violating her probation by getting arrested. Due to overcrowding, the Los Angeles County Sheriff’s Office allowed her to serve out her time at home, where she was spotted throwing a party for pals June 13. Though given a four-month sentence, she only had to serve 35 days, and was nearing the end of the stretch when she reportedly failed the alcohol test last week.
